1. Acceptance of Terms

By accessing or using our AI video generation service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Service.

2. Service Description

Turlan Management Limited provides an AI-powered video generation service using advanced artificial intelligence technology. Our Service allows you to:

• Submit text prompts to generate custom AI videos
• Upload reference images to guide video generation (optional, depending on model)
• Receive generated videos via secure download link sent to your email
• Choose between multiple AI models including Sora 2, Sora 2 Pro, and Kling 2.6, each with different capabilities and pricing
• Select from various video durations (5, 10, 15, or 25 seconds depending on the model selected)
• Optionally enhance your prompts using AI-powered optimization (requires explicit consent)
• Optionally upscale videos to 4K resolution for higher quality output (additional credits required)

2.1 User Accounts

To use our Service, you must create an account by signing in with Google OAuth. By creating an account, you:

• Authorize us to receive your name, email address, and profile picture from Google
• Agree to maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Agree to notify us immediately of any unauthorized access to your account

2.2 Credit System

Our Service operates on a credit-based system:

• Credit Packages: You purchase credits in packages (e.g., 500, 1,000, 2,500, or 5,000 credits) at fixed prices
• Bonus Credits: Larger packages include bonus credits as indicated at checkout
• Credit Consumption: Each video generation consumes credits based on the model selected, video duration, and optional features (such as 4K upscaling or audio)
• Credit Balance: Your credit balance is displayed in your dashboard and does not expire
• Non-Refundable: Purchased credits are non-refundable except as outlined in our Refund Policy
• Non-Transferable: Credits cannot be transferred between accounts or converted to cash

2.3 Prompt Enhancement Feature (Optional)

We offer an optional prompt enhancement feature that uses AI to improve your video prompts for better results. This feature:

• Requires your explicit consent before each use
• Sends your prompt text to our third-party AI provider (OpenRouter) for processing
• Is completely optional—you can generate videos without using this feature
• May result in your prompt data being retained by the AI provider as described in our Privacy Policy

3. Pricing and Payment

Credit packages are available for purchase at prices displayed on our checkout page. Prices are shown in multiple currencies (USD, EUR, GBP, and others) for convenience. All prices displayed at checkout are final prices. Turlan Management Limited is not registered for VAT.

3.1 Credit Package Pricing

We offer various credit packages to suit different needs:

• Starter: 500 credits
• Popular: 1,000 credits + bonus credits
• Pro: 2,500 credits + bonus credits
• Studio: 5,000 credits + bonus credits

Exact pricing and bonus amounts are displayed at checkout and may vary by currency.

3.2 Payment Methods

Payment is processed securely through Stripe using Apple Pay, Google Pay, credit/debit cards, or other express checkout methods. By making a purchase, you agree to Stripe's terms of service and privacy policy.

3.3 Price Changes

We reserve the right to modify credit package pricing at any time. Any price changes will not affect:

• Credits already purchased and in your account
• Transactions already in progress

4. Content Policy and User Responsibilities

4.1 Acceptable Use

You are solely responsible for the content of your prompts and any reference images you upload. You agree not to submit content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or offensive
• Violates any third-party rights, including intellectual property rights
• Contains explicit sexual content or nudity
• Depicts violence, gore, or harmful activities
• Promotes discrimination, hatred, or violence against individuals or groups
• Contains personal information of others without consent
• Attempts to generate deepfakes or misleading content about real individuals
• Violates applicable content guidelines or AI usage policies

4.2 Content Moderation

All prompts are automatically screened using OpenAI's Moderation API. Prompts that violate our content policy will be rejected before payment processing. We reserve the right to:

• Refuse service for any content that violates our policies
• Report illegal content to appropriate authorities
• Terminate access for repeated violations

5. Refund Policy

5.1 Credit Refunds for Failed Generations

Credits will be automatically refunded to your account in the following circumstances:

• Technical Failure: If our system fails to generate your video due to technical errors
• Non-Delivery: If video generation fails and no output is produced
• Content Policy Rejection: If your content is rejected during generation due to policy violations

5.2 Payment Refunds

Full payment refunds may be issued in the following circumstances:

• Unused Credits: If you have not used any credits from a recently purchased package, you may request a refund within 14 days of purchase
• Service Unavailability: If the Service becomes permanently unavailable

5.3 Non-Refundable Scenarios

Refunds will NOT be provided for:

• Successfully generated videos that meet technical specifications
• Dissatisfaction with the artistic or creative output of the AI
• Videos that accurately reflect the submitted prompt
• Change of mind after successful generation
• Failure to download within the 30-day window
• Partially used credit packages
• Unused credits after 14 days from purchase

5.4 Content Policy Violations

If your content is rejected due to policy violations, your credits will be refunded to your account balance. However, repeated violations may result in permanent ban from the Service and forfeiture of remaining credits.

6. Intellectual Property Rights

6.1 Your Content

You retain all rights to the prompts and reference images you submit. By using our Service, you grant us a limited, non-exclusive license to use your content solely for the purpose of providing the Service.

6.2 Generated Videos

Subject to the terms below, you own the rights to use the generated videos for personal and commercial purposes. However:

• The underlying AI model and technology remain the property of their respective owners
• Similar prompts may produce similar results for other users
• We do not guarantee exclusive or unique outputs

6.3 Our Rights

Turlan Management Limited and its licensors retain all rights to:

• The Service platform and interface
• Our trademarks, logos, and branding
• Any improvements or modifications to the Service

7. Privacy and Data Protection

We are committed to protecting your privacy in accordance with the General Data Protection Regulation (GDPR) and Irish data protection laws. Our processing of personal data is governed by our separate Privacy Policy.

7.1 Data We Collect

• Email address for delivery purposes
• Payment information (processed by Stripe)
• Prompts and uploaded images for video generation
• Technical data for service improvement

7.2 Data Retention

• Generated videos are stored for 30 days for download purposes
• Reference images are deleted after video generation
• Transaction records are kept as required by law

8. Delivery and Access

8.1 Delivery Method

Videos are delivered via secure download link sent to your provided email address. Download links are valid for 30 days from generation.

8.2 Your Responsibilities

• Provide a valid email address
• Download your video within the 30-day window
• Ensure your email can receive messages from our domain
• Check spam/junk folders if delivery email is not immediately visible

9. Limitation of Liability

9.1 Service Availability

While we strive to maintain high availability, we do not guarantee uninterrupted or error-free service. The Service is provided "as is" and "as available."

9.2 Limitations

To the maximum extent permitted by Irish and EU law, Turlan Management Limited shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, revenue, or data
• Damages arising from your use or inability to use the Service
• The content or accuracy of generated videos
• Any third-party actions or content

9.3 Maximum Liability

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid for the specific transaction giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Turlan Management Limited, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any third-party rights
• Your content or use of the Service
• Any misrepresentation by you

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of the Service after any modifications indicates your acceptance of the updated Terms.

We will make reasonable efforts to notify users of significant changes via email or prominent notice on our Service.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Repeated content policy violations
• Any conduct harmful to other users or the Service

Upon termination, your right to use the Service will immediately cease.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Ireland.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and Turlan Management Limited concerning your use of the Service.

16. Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
